A BILL to amend article three, chapter thirty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, by
adding thereto a new section, designated section nineteen,
relating to requiring the board of medicine to propose
legislative rules to regulate prescriptions of narcotic drugs
as set forth under schedule II in section two hundred six,
article two, chapter sixty-a of this code.
Be it enacted by the Legislature of West Virginia:
That article three, chapter thirty of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section
nineteen, to read as follows:
ARTICLE 3. WEST VIRGINIA MEDICAL PRACTICE ACT.
§30-3-19. Board to propose rules to regulate schedule II narcotic
prescriptions for minors.



The board of medicine shall propose rules to regulate the
prescription of controlled substances to minors as listed under
schedule II in section two hundred six, article two, chapter
sixty-a of this code for legislative approval in accordance with
the provisions of article three, chapter twenty-nine-a of this
code.



The rules shall set forth standards and restrictions for
prescribing schedule II controlled substances to minors.



NOTE: The purpose of this bill is to require the Board of
Medicine to propose legislative rules governing the prescribing of
potent narcotic substances to minors.
